EOTAS: what is it, and how does it differ from home education?

What Education Otherwise Than At School actually means, and why it's legally different from Elective Home Education.

EOTAS, Education Otherwise Than At School, is a package of education arranged and funded by the local authority for a child or young person with an EHC plan, for whom attending any school, college, or early years setting isn't appropriate.

It's set out in Section 61 of the Children and Families Act 2014, which allows a local authority to arrange this kind of provision where it's satisfied that school-based education wouldn't be suitable.

How is this different from home education?

  1. With Elective Home Education, a parent chooses to take on responsibility for their child's education, and the local authority's duty under the EHC plan effectively steps back
  2. With EOTAS, the local authority remains legally responsible for arranging and funding everything set out in the plan, the duty doesn't go away

Where does EOTAS show up in a plan?

Where EOTAS is agreed, Section I (placement) is usually left without a named school, and the actual provision is set out in detail in Section F instead, which is the legally enforceable part. EOTAS can be requested during an assessment, a reassessment, or an annual review, and is often raised where a placement has broken down.

The difference between EOTAS and simply choosing to home educate is one of the most commonly misunderstood distinctions in this whole area. SEND Assistant helps you understand which route actually fits your child's situation. Try SEND Assistant free.
